By accessing or using the Wisebite mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). The Service is operated by Wisebite Ltd. ("we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

WISEBITE IS NOT A MEDICAL PROVIDER AND DOES NOT PROVIDE MEDICAL ADVICE.

Informational Purposes Only: All content—including AI-generated analysis, ingredient flags, and nutrition insights—is provided for general informational purposes. It is not a substitute for professional medical advice, diagnosis, or treatment.

No Doctor-Patient Relationship: Your use of the Service does not create any professional or fiduciary relationship.

EMERGENCY USE: DO NOT USE WISEBITE IN A MEDICAL EMERGENCY. If you believe you are experiencing an allergic reaction or any medical emergency, contact your local emergency services (e.g., 911 or 112) immediately.

THE PHYSICAL PRODUCT LABEL IS THE SOLE FINAL AUTHORITY.

Database Limitations: Product formulations change frequently. Our database may be outdated or contain errors.

AI Imperfections: AI-assisted analysis may generate inaccurate, incomplete, or misleading results. Wisebite does not guarantee the accuracy of any ingredient analysis.

User Duty: You agree that you have a duty to independently verify all ingredients by reading the physical packaging of a product before consumption. Do not rely on Wisebite as your primary safety check for life-threatening allergies or medical dietary requirements.

Age Requirement: The Service is not directed toward children under 13 years of age. You must be at least 18 years of age to create an account. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.

Account Security: You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use.

Billing: Subscriptions purchased through the Apple App Store or Google Play Store are managed by those respective platforms.

Cancellations: You must cancel your subscription through your platform settings at least 24 hours before the renewal date to avoid being charged.

Refunds: All refund requests are handled by Apple or Google and are subject to their respective policies.

You agree not to:

• Use the Service for any illegal purpose or to diagnose/treat a medical condition.
• Scrape, crawl, or use automated systems to extract data from the Service.
• Attempt to reverse engineer any part of Wisebite's software or AI models.
• Resell or commercially exploit Wisebite data without written permission.

All content, software, AI models, logos, and designs are the exclusive property of Wisebite Ltd. or its licensors. We grant you a limited, non-exclusive, revocable license for personal, non-commercial use.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISEBITE LTD. SHALL NOT BE LIABLE FOR:

• ANY ADVERSE HEALTH OUTCOMES, ALLERGIC REACTIONS, OR INJURIES.
• INACCURACIES, ERRORS, OR OMISSIONS IN PRODUCT DATA OR AI ANALYSIS.
• DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

You agree to indemnify and hold harmless Wisebite Ltd., its officers, and employees from any claims, damages, or expenses (including legal fees) arising from your misuse of the Service or your violation of these Terms.

Binding Arbitration: For users in the United States and other applicable jurisdictions, you agree that any dispute arising from these Terms will be resolved through binding individual arbitration, rather than in court.

Class Action Waiver: You waive the right to participate in any class-action lawsuit or class-wide arbitration.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Wisebite Ltd. is registered, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. We will notify you of material changes via in-app notification or email. Your continued use of the Service following such changes constitutes your acceptance of the new Terms.

Users may request deletion of their account and associated personal data by contacting team@wisebite.net.
